Employment law
Employment combines contractual rights, legislation and employer policies. When conditions change or employment ends, both the reason and the procedure need examination. The office advises employees and employers through a review of documents and the circumstances of the particular relationship.

Understanding your legal matter
For an employment matter, prepare a timeline of employment, contract amendments and disputed events. Identify any employer decision and when it was received. The office advises employees and employers in Serbia; assessing the options requires the actual documents and circumstances rather than a general description alone.
- Employment contracts and employer policies
- Termination of employment and disputed payments
- Advice for employees and employers
Employment contracts and amendments
Review the role, place of work, duration, hours and other obligations when employment begins. Contract terms must be considered alongside applicable employer policies, collective agreements and legislation.
An offered amendment requires careful consideration of its reasons and changes. Understand the effects before accepting or refusing it. Keep the offer, supporting documents and evidence of when they were received.
Dismissal and procedural requirements
Dismissal review covers the stated ground, supporting facts and the procedure followed. Depending on the reason, relevant documents may include a warning, employee response, performance assessment or organisational records.
Challenging a decision and claiming payments may involve different time limits. Have the decision and receipt evidence reviewed promptly. Informal discussions with an employer should not lead to overlooking the period for legal protection.
Article 195 of the Labour Act provides 60 days from service of the decision or knowledge of the infringement for the dispute covered by that provision. Under Article 196, employment payment claims become time-barred three years after the obligation arises. Any special employment regime and the starting date must be checked for the particular case.
Wages and other employment claims
A payment dispute requires contracts, payslips, work records and bank statements. Overtime and other increases may also require instructions, schedules and evidence of the work actually performed.
Distinguish a disagreement over calculation from recovery of an established amount. The available route depends on the documents and claim. Organise records by month, identifying payments and disputed sums.
Legal support for employers
Consistent contracts, policies and decisions clarify responsibilities before a dispute arises. Documents should reflect the real organisation of work, rather than existing only as paperwork.
We review proposed employment changes, prepare agreed documents and consider service requirements. When employment ends, particular attention is given to whether the records support the stated reason.
Preparing an employment matter
Bring the contract, all amendments and a chronology. Relevant business correspondence lawfully available to you may assist. Preserving evidence does not authorise access to someone else’s accounts or company databases.
For workplace injury, incident reports and medical records are reviewed alongside employment documents. Employment protection and compensation can overlap, but each requires its own assessment of requirements and evidence.
Documents for the first meeting
- Contract, amendments and applicable employer policies.
- Decision, warning and evidence of receipt.
- Payslips, bank statements, schedules and work records.
If you do not have a document, mention this when arranging the meeting. A brief summary is enough for an initial enquiry; send sensitive documents through an agreed channel.
Questions about this area
Are agreed termination and dismissal the same?
No. An agreement depends on consent, while dismissal is a unilateral decision subject to legal requirements. Understand the document’s consequences before signing.
Can I seek advice without every payslip?
An initial assessment can start with what you have. Identify the missing documents and period so the appropriate way to obtain further evidence can be considered.
Do identical rules apply to every job?
Special laws may apply to particular employees and the public sector. State the employer, position and legal basis of the engagement when seeking advice.
Legal framework and sources
