Inheritance law
An inheritance matter involves more than an inventory. Heirs, the basis of succession, any will and the deceased’s obligations must be identified. Particular care is needed with inheritance declarations and agreements affecting what forms part of the estate.

Understanding your legal matter
For an inheritance matter, prepare an outline of family relationships, known assets and relevant documents. Mention any notice or decision already received and whether the heirs disagree. Reviewing wills and succession-related agreements helps identify the particular issues that need to be addressed under Serbian law.

Probate and identifying the estate
Probate establishes the heirs and property included in the estate. A notary may act as the court’s delegate. Disclose known rights and documents, including information not covered by the initial notice.
Disagreement over whether an asset belonged to the deceased or who inherits can require separate proceedings. The appropriate response depends on the issue, not simply whether everyone attends the hearing.
Intestacy and wills
Succession may follow the law or a will. Family relationships, descendants, a spouse and other relevant circumstances determine who may inherit. Informal family expectations do not replace legal assessment.
Where a will exists, review its form, contents and execution circumstances. Preserve the original and information about other wills or agreements. A validity challenge needs legal grounds and evidence, beyond dissatisfaction with the distribution.
Reserved shares and earlier transfers
Reserved-share rules can limit certain dispositions affecting qualifying heirs. Entitlement and the appropriate claim depend on the relationship, estate and relevant gifts or testamentary dispositions.
Gather records of earlier transfers, value and acquisition. A gift, sale and lifetime maintenance agreement have different legal characteristics and should not be treated as equivalent transfers.
Acceptance, renunciation and debts
An inheritance declaration can have lasting consequences. Renunciation differs from transferring a share to a named co-heir. Understand what the proposed declaration means for you and the particular heirs before making it.
Review the deceased’s debts and the statutory limits of heirs’ liability, rather than assets alone. Where debt records are incomplete, identify known creditors and proceedings for further investigation.
Lifetime maintenance and later-discovered assets
A lifetime maintenance agreement requires review of its subject, obligations and mandatory form. Its consequences differ from a will, so the contracted property’s position cannot be assessed solely by its earlier ownership.
If more property is found after probate, consider the procedure for dealing with it. Bring the final inheritance decision and evidence of the additional right or asset. Earlier completion does not make new information irrelevant.
Documents for the first meeting
- Probate notice, any inheritance decision and heir information.
- Will, agreements and evidence of assets and known debts.
- Earlier transfer records and evidence of newly discovered property.
If you do not have a document, mention this when arranging the meeting. A brief summary is enough for an initial enquiry; send sensitive documents through an agreed channel.
Questions about this area
Can I renounce only the debts?
A declaration cannot be used simply to select assets and discard obligations. Review the estate and statutory rules on liability before making it.
What does renunciation in favour of another heir mean?
Serbian law treats this differently from pure renunciation: as acceptance followed by transfer of the share. Clarify its consequences before making the declaration.
What if I live abroad?
Representation may be possible after checking the power of attorney’s scope and form. Foreign documents may need translation or certification depending on the country and instrument.
Legal framework and sources
Official sources and legislation in Serbian. Their application depends on the facts and rules relevant to the particular matter.
