Tax law
A tax question may arise before a transaction, when filing a return or after a decision arrives. Identify the obligation, period and competent authority first. The office provides legal advice and representation, reviewing facts and documents and coordinating with an accountant where needed.

Understanding your legal matter
Connect a tax question to the particular obligation, period and authority document. Bring returns, calculations, decisions and evidence of receipt where available. Explain what you dispute or need clarified and whether proceedings have begun. Advice depends on the records and circumstances of the individual matter in Serbia.
- Reviewing tax decisions and supporting records
- Advice for individuals and businesses
- Representation before tax authorities
Identifying the relevant obligation
The same event can raise different issues for an individual, sole trader or company. The type of income or transfer, timing and parties’ status all matter.
Consider the legal implications before signing documents or implementing a change. The label used for a payment is not the only relevant factor. Legal review and accounting calculations have connected but distinct purposes.
Returns and consistent supporting records
Review the period, legal basis and supporting material for a return. Contracts, business records and earlier filings should be considered together to identify inconsistencies before explanations are sent.
Where an error is found, assess the proper correction route against the return type and procedural stage. Avoid submitting inconsistent explanations without reviewing earlier submissions and applicable requirements.
Tax audits and responses
For a notice, request or audit report, establish what is required, which period it concerns and the deadline. Organise the documents to provide a clear, evidenced response to the specific findings.
Review agreements, invoices, statements and previous communications. For disputed findings, identify the facts, legal basis and opportunity to respond at that stage. Keep evidence of each submission and receipt.
Appeals and further legal protection
Read a tax decision together with its reasons and remedy instructions. Objections should identify the particular factual or legal error and supporting evidence. Simply saying the amount is excessive may not establish a legal defect.
Do not assume that an appeal automatically suspends enforcement. Assess any basis for postponement and required evidence separately. Further court protection depends on the type and finality of the act and procedural rules.
The general appeal period in Article 142 of the Tax Procedure and Tax Administration Act is 15 days from receipt of the tax administrative act, unless legislation provides otherwise. Check this together with the service method and remedy instructions in the particular act.
Authority and preparing the file
The Tax Administration handles some obligations, while real-estate property tax, for example, falls within local tax administration. Identify which authority handles the particular matter before making a submission.
Bring the complete act, receipt evidence and earlier returns and responses. Prepare separate chronologies for different periods or authorities. This helps identify open issues and avoids mixing distinct proceedings.
Documents for the first meeting
- Decision, audit report or notice and service details.
- Returns and submission confirmations for the relevant periods.
- Agreements, invoices, statements and earlier authority correspondence.
If you do not have a document, mention this when arranging the meeting. A brief summary is enough for an initial enquiry; send sensitive documents through an agreed channel.
Questions about this area
Does an appeal mean I can ignore the decision?
Do not assume so. The appeal’s effect and possible postponement require separate review under the law and particular decision. Mention any enforcement already underway.
Does legal advice replace accounting?
No. Legal grounds, remedies and representation differ from bookkeeping and calculations. Complex matters may benefit from coordination between the lawyer and accountant.
What if I received the decision electronically?
Keep the document and available electronic delivery records. The date and method of service can matter for deadlines and subsequent steps.
Legal framework and sources
Official sources and legislation in Serbian. Their application depends on the facts and rules relevant to the particular matter.
